Developer’s Agreement With Tenant Deed Format

This agreement is made this 5th day of January 2000 between AB Ltd. a company registered under the Companies Act 1956 and carrying on business at ………………. (hereinafter referred to as the developer) of the One Part and Mr. MN residing at ………………… (hereinafter referred to as the tenant) of the Other Part and Mr. XY of ………………….. (hereinafter referred to as the owner) the confirming Party.

Whereas Mr. XY is the owner of the premises at ………………….  under whom and in which premises on the ground floor Mr. MN is a monthly tenant in respect of a flat of 600 sq. ft. carpet area.

And whereas the said owner and developer have agreed to demolish the existing structure at the said premises at ………………………… and to construct a multi-storeyed building thereon.

And whereas it is necessary that the tenant should vacate the said premises to facilitate demolition of existing structure and construction of the multi-storeyed building.

And whereas the tenant has agreed to vacate the said premises on the assurance of developer that the tenant would be given a similar accommodation in the multi-storeyed building at a rent of Rs. 3 per sq. ft. of carpet area.

Now these presents witnesseth and the parties hereby agree as follows:

1. The developer shall provide the tenant temporarily with a similar accommodation with similar facilities in the vicinity of the present locality at the same rent.

2. On such temporary accommodation being given the tenant will shift to the new accommodation giving absolute vacant possession of the said flat to the developer.

3. The tenant shall continue in possession of the temporary accommodation till he is given a flat in the multi-storeyed building to be constructed.

4. On getting vacant possession of the premises the developer shall with due dispatch demolish the existing structure and start construction according to sanctioned plan and on obtaining the requisite permissions of the authorities concerned and in accordance with the agreement with the owner.

5. After the construction has been completed or partly completed the developer on obtaining the necessary certificate shall give to the tenant in the building similar accommodation and the tenant will shift from his temporary accommodation to the new building as a tenant under the owner and pay the agreed rent at Rs. 3 per sq ft. of the carpet area.

6. The tenant agrees to be a member of and/or join any association or body formed by other occupants, tenants or owners of the flats or apartments and comply with the statutory provisions in relation to the multi-storeyed buildings.

7. The tenant agrees that he made all necessary enquiries before entering into these presents and that he shall not be entitled to complain about the amenities and nature and quality of the construction if the same have been done according to the sanctioned plan.
